Carrington Estate Jade LP - Application for earthworks

The following application for a resource consent has been received by the Northland Regional Council and is publicly notified pursuant to Section 95A of the Resource Management Act 1991.

Activity description

The application seeks resource consents for earthworks, and associated stormwater diversion and discharge, for a proposed 140 lot residential subdivision.

The following activities were included in the application:

  • Approximately 50,000 cubic metres of earthworks over an area of approximately 22.4 hectares for site development; and 
  • Diversion of water during earthworks activities; and 
  • Discharge of water to land during earthworks activities. 

 

Additional information on the application was requested by the Northland Regional Council in accordance with Section 92(1) of the RMA to confirm the presence and extent of any natural inland wetlands within, and within 100 metres of, the proposed area of earthworks.  The information was requested to determine if additional consents are required under the Proposed Regional Plan for Northland and/or the Resource Management (National Environmental Standards for Freshwater) Regulations 2020 for the following activities: 

  • Earthworks within, or within 10 metres of, a natural inland wetland; 
  • Vegetation clearance within, or within 10 metres of, a natural inland wetland; 
  • The diversion of stormwater within 100 metres of a natural inland wetland.  

The requested information was not provided by the Applicant.   

The Northland Regional Council then sought agreement from the Applicant to commission a report on the same matters, in accordance with Section 92(2) of the RMA.  The applicant did not respond to this request.  

Given the lack of response to both Section 92 requests, the Northland Regional Council is therefore required to publicly notify the application in accordance with Section 95C of the RMA.
