Plan Change 2 - Backyard Burning

The decisions on Plan Change 2 were notified on Saturday 5 April 2008. Backyard burning will become a permitted activity, subject to conditions outside the Whangarei Airshed, and on properties over 10,000 m2 (1ha) within the Whangarei Airshed. On properties under 10,000m2 (1ha) in the Whangarei Airshed, backyard burning will become a restricted discretionary activity, requiring resource consent.

The Environment Court appeal period closed on Monday 19th May 2008. 

This Plan change was first notified on Thursday 2 August 2007, with the submission period closing on Friday 31 August 2007. 

Further submissions were invited on the 6th October and closed Friday 9th November 2007.

The hearing for submissions on Plan Change 2 was held on Monday 17th December in Whangarei. A total of ten submissions were heard by the hearings committee.

Purpose of the change

The purpose of this plan change is to ban the outdoor burning of waste in the area defined by the Whangarei Airshed.  The proposed plan change will also make burning on all other private land in the Northland region a permitted activity, subject to conditions, ensuring the burning does not affect any adjoining landowners.

It is anticipated that banning burning in the Whangarei Airshed, and placing controls on the permitted burning of waste in the Northland region, will reduce the amount of inhaleable soot being released into the atmosphere. 

This will have significant air quality and health benefits, while also reducing the amount of burning and smoke nuisance complaints being received by the Northland Regional Council.

Where is the plan change process at now?

One appeal was lodged with the Environment Court. Council staff are currently working through the necessary processes.
