marinaThe Plan Change covers a raft of issues relating to moorings and marinas. The Plan Change also results in a number of amendments to identified mooring areas to better represent the actual location of current moorings.

The plan change has been adopted by council and is awaiting sign off from the Minister of Conservation.  However, council has recently decided to undertake a variation to the plan change.  

Variation 2 to Plan Change 1

Background

In June 2011, the Regional Council decided to prepare a variation to Plan Change 1 to remove all existing provisions from the plan change relating to the development of Mooring Management Plans (MMPs). There will also be some additional changes to how moorings will be dealt with within mooring areas.

Council decided to undertake the variation because the development of MMPs (which are site specific mooring plans) was proving too costly and it became apparent that it would be difficult to agree who should pay for and provide new land based facilities in association with mooring areas.

Proposed Variation

The proposed variation to Plan Change 1 aims to cut red tape for existing moorings and enable better management of sewage discharges in moorings zones.

Under current rules, all moorings in mooring zones require resource consent – including roughly 2000 existing moorings that pre-date the rules.  Making these existing moorings ‘permitted’ would remove the resource consent requirement, cutting red tape and costs for mooring holders and the council. New moorings would still require resource consent.

While it’s illegal to discharge untreated sewage in mooring zones it still happens from time to time – and it’s not good for our water, the people, plants and animals exposed to it, or the economy that depends on it. With current rules it’s hard for the council to take action, so under the proposed variation people wanting to stay overnight on their vessel in a mooring zone will need a way to contain their sewage.  For stays of more than five nights sewage would need to be properly discharged.

Council decisions

Council publicly notified decisions on Variation 2 to Plan Change 1 on 22 December 2012.  The appeal period ended on 22 February 2013 and no appeals were received.  This now means that Variation 2 has ‘caught up’ to Plan Change 1.  Council now needs to formally adopt Variation 2, affix the council seal to Plan Change 1 and forward it to the Minister of Conservation for approval.

The maps show the new Marine 4 (Moorings including Marinas) Management Areas. These will be inserted into the Regional Coastal Plan for Northland Maps once Plan Change 1 (Moorings and Marinas) is made operative. The Marine 4 (Moorings) Management Areas currently identified in the Regional Coastal Plan that are unmodified by Plan Change 1 (Moorings and Marinas) are not shown in these maps.
